The new "Super" drunk law...

Drunk driving first offense = 1 year in prison. No questions.

Second offense = 5 years in prison.

Third offense = third strike. Enjoy your 6x6 for the rest of your life.

I'll believe this when I see it work. I'm all for the idea, but I've seen too many times where a prosecuting attorney pleas down & pleas down just to get a conviction on his record - & meanwhile there's a jackass out there drinking & driving & yet to pay for it in anyway. I know of 1 who has been stopped 6 times for drinking & driving in the last year or 2. He's done ZERO time.

I have a cousin who was caught seven times and did zero time. To be fair, his last time it was on a moped.

This is why i have a kegerator, a 52 in tv and the sports packages @ home. Don't need to leave. :)

I don't have the kegerator but always offer 3 to 4 types of beer at the 3M residents with sports on.

I think he meant he's glad you weren't popped before for being .08....

I'm all for stopping drunk driving but I would like to see some scientific evidence that .08 is "drunk". As I wrote in another thread, I"m deeply suspicious of what MADD has turned into. They're no longer about drunk driving, it's about drinking in general.

This is a very good observation. I ran into this group quite often on campus during college (I attended 04-10) and their message went from dont drink and drive to you will burn in hell for opening that beer.

the point of my post is that you made it seem you drive drunk, but won't anymore due to this new law. It's a good thing in a way, I guess, but it's disturbing to me that you were doing it before. Unless that was tongue in cheek.

You really missed his point. What he said was this would mean he probably would not have anything alcoholic prior to driving. Anything is a far distance from drunk. Myself, I could probably down a six pack during a game and not blow 0.08. I wouldn't for the obvious reasons.

I guess so...but it doesn't make sense to me that it would stop him from doing that at all, when it only affects those who get destroyed and drive... Unless I'm missing something, which is pretty likely.

Law, levels and all are not really my issue with alcohol and driving for the casual drinker. What does concern me is being stopped after one drink and the officer smells alcohol. I will have much more of a hassle than a simple infraction. I don't want that.

No, he didn't. Grim either worded it badly or meant that the new law means he no longer drinks and drives which implies that he previously did drink and drive. Since the law specifically pinpoints 'super drunks', it makes Grim look like a super drunk.

Yes, I agree with this as well. It's like that stupid assumption that anyone that might get drunk is an alcoholic. No, some people just get drunk once in a while. Another one is how everyone that smokes marijuana is a bad person and stupid and a drug addict. Not the case at all.

We'll see how the "super-drunk" law really goes when the first rich and famous person gets nailed on it.

I have had a big problem in recent years with wealthy politicians, athletes and performers getting away with it for the most part. Dante Stallworth KILLED someone and went to jail for 30 days. 30 freaking days. How many chances is Linsday Lohan gonna get? Remember State Rep David Jaye? - he had at least four DUI arrests (imagine how many times he didn't get caught).

We just saw it after the Michigan - MSU game when Chris Rucker gets popped for DUI, it gets withered down to Reckless Driving and he's back on the team. Why? He was already on probation, why is he getting a break? Oh, the team is undefeated this year.....

If you want to show folks you are serious about these laws, you have to show it on public figures. I am not for mandatory minimums because each case should be based on its own merits, but our legal system is not taking this as seriously as they should.

I rarely ever drink more than one beer anymore because I am afraid if I come up with a .04 or .05 there is gonna be some obscure law that determines that as being drunk.

By the way, a friend of mine that lives in suburban Boston got arrested for public intoxication because when the cops came by to tell him about the noise from his house, they told him to pour his beer out. He was on his own lawn and he refused and told them to leave his property. When he went to go back into his house to turn down the radio, they cuffed him and arrested him. It wasn't even dark outside yet. The charges were later dropped, but not before it cost him some money. The abuse goes both ways.

That's one reason I don't live in the 'burbs, to be honest. My neighborhood can be noisy at times but I prefer it to living in a place that still thinks the Puritans are in charge.

(it wasn't Brookline, was it? 'Cause that would ruin my point.)

edit: fwiw, I read GR's post as meaning he wouldn't even drive after a glass of wine with dinner, as I think HT did.

This is anecdotal, but whenever I read about a case where a drunk driver was really, really off the rails, like hitting a pedestrian 10 feet off the road, I also read that he/she was blowing over .20.

Seems like a very good law to me.

Possibly. But if someone with a .08 in their bloodstream doesn't drive, no one loses.

I remember a parent on Boston TV wanting some woods razed because kids would be smoking pot and having sex back there, and the reporter asking her how she knew this and the woman said "because that's what we used to do". I think it was in Somerville.

I'm not sure of your size, but remember your tolerance doesn't necessarily ride parallel with your blood alcohol content. A six pack, in a short time, would have most people blowing over .08. I'd trust my kids in a car with some people I know after drinking a six pack in a short time over my wife just after finishing a tall glass of wine. Still, the cop would let my wife continue driving my kids home while the other folks i'm thinking of would be going to jail.

Not trying to justify anything, but I am talking about showing up at the ballpark by 6 pm with the game ending around 10:30. I have tried the OTC testers as a lark (never after a 6 pack) and 3 16 oz. would put me in the 0.03-4 range. Too close to depend on. I limit at two or the wife drives home. Also we must eat at the park during that time.

I used to have to walk through the Victory Gardens in the Fenway to get to work in the early morning. I learned very quickly that when you hear something rustling in the bushes, don't look.
